Regulations of the online store https://seelanii-lingerie.com/

§ 1 Subject matter and rules of sale

The present regulations specify the rules of using the online store, acting at the address https://seelanii-lingerie.com, placing orders for Goods available in this store, delivery of ordered Goods to the Buyer, payment by the Buyer of the price for the purchased Goods, as well as rights of the Buyer relating to the sales agreement, including remote sales.
The Internet store https://seelanii-lingerie.com conducts sales via the Internet (contract concluded at a distance).
In order to place an Order, it is necessary for the Buyer to become familiar with these regulations and to confirm this fact. By placing an Order the Buyer confirms his/her acceptance of these Regulations.

§ 2 Definitions

All capitalised terms have the meaning as defined below:

Order processing time – time in which the Store completes the order and transfers it to the carrier implementing the form of delivery chosen by the Buyer

Working days – days of the week from Monday to Friday, excluding public holidays

Sales document – a document confirming sales in the form of a VAT invoice or receipt, selected by the Buyer at the stage of placing an Order and delivered to the Buyer – in the case of a receipt – in the form of a VAT invoice or receipt.
in case of a receipt – in paper form together with the shipment containing the ordered Goods, and in case of an invoice – in electronic form, to the e-mail address specified by the Buyer

Form of delivery – a method of delivery of the ordered Goods selected by the Buyer when placing the Order

Method of payment – a method of paying the price for the ordered Goods, selected by the Buyer while placing the Order

Order form – a questionnaire available at the Seller’s website, with the help of which the Buyer orders the Goods

Consumer – a Buyer who is a natural person, making an order, purchase or in any other way using the Store, for the purpose not directly connected with his/her business or professional activity

Buyer – a natural person with full or limited legal capacity, a legal person or an organizational unit without legal personality, who on terms specified in these Terms and Conditions uses the Store

Store – internet service available at https://seelanii-lingerie.com, conducted by the Seller, through which the Buyer may order and purchase goods

Goods – movable things, presented in the Store, which may be subject to a contract of sale

Sales agreement – a contract of sale of Goods, concluded between the Seller and the Buyer through the Store and documented by the Sales Document

Order – an offer made by a Buyer via the Store to conclude a contract of sale with the Seller

§ 3 Placing Orders

In order to place an Order and conclude a contract, it is necessary for the Buyer to have an electronic mailbox (e-mail) and a web browser, e.g. Chrome, Safari, Firefox, etc.
The Goods are ordered by choosing the Goods in the Store, taking subsequent technical actions on the basis of displayed messages, including adding the Goods to the basket. The Buyer can at any time view the contents of the basket, add or remove Goods.
During the process of placing an order, the Buyer is obliged to specify the shipping address of the Goods, telephone number, e-mail address, choice of payment method and may also declare a desire to receive a VAT invoice to the receipt.
The Buyer can make a registration in the Shop. Registration makes it possible to store in the Shop’s database the Buyer’s personal data and history of his Orders and also enables him to access the Orders.
During registration the Buyer is obliged to give a unique password known only to himself. The process of registration and placing Orders is encrypted with the appropriate protocol.
The Buyer is responsible for not disclosing his password to third parties and is liable for making it available.
After placing an order, the Seller sends, to the e-mail address given by the Buyer (in the order form), a confirmation of accepting the order, including all significant elements of the order, such as order number, total price of the order (specifying the prices of individual items and the price of delivery), the time of completing the order, the form and approximate date of delivery.
The conclusion of the contract by the parties occurs at the time of receipt by the Buyer of the confirmation of order acceptance by the Seller. The condition of acceptance and processing of the order by the Seller is correct and complete (to the extent necessary) filling of the order form by the Buyer.

The order shall not be accepted by the Seller if the Buyer includes incomplete data in the order form, which makes verification of the Buyer and proper delivery of the Goods impossible. In case the Buyer cannot be contacted due to an incorrect address or telephone number, the order shall be cancelled.

§4 Prices and payment

Prices of all goods presented in the Store are gross prices (including VAT) and expressed in Polish zloty (PLN). Binding on the parties to the transaction is the price of each item shown on the Seller’s website
of a particular item shown on the Seller’s website at the time of placing an order by the Buyer. The price of goods does not include delivery costs, where information about the cost of delivery of goods is given when placing an order.
The cost of shipping the Goods shall be paid by the Buyer.
The Buyer has the right to choose the method of delivery and method of payment. The choice of payment method is made by the Buyer in the order form.
The Seller offers the following forms of payment:
payment via the Internet in the PayU/PayPal/Blik system while placing the order, i.e. during the process of ordering the Goods the Buyer makes payment for the Goods,
and the order is executed subject to positive authorization of the Seller from the electronic payment operator and the Buyer’s bank;
payment by bank transfer to the bank account of the Seller, whereby the order will be executed upon receipt of funds to the following bank account of the Seller: Kristen Fernandes, ul. Kleczkowska 49B/29, 50-227 Wrocław, NIP:8992902944, account no: 24 1020 5226 0000 6302 0715 9942

The cost, date and method of delivery of the Goods shall result from the form of delivery chosen by the Buyer in the order.

§ 5 Delivery of goods

Deliveries of goods ordered in the Store are executed in the territory of the Republic of Poland.
The Seller within 3 weeks (counted only as Business Days) from the date of positive authorization from the electronic payment operator and the Buyer’s bank, or from the date of payment in full to the Seller’s bank account, sends to the address specified by the Buyer the ordered Goods, together with the Sales Document.
The Goods shipping date may be extended if the Seller has set a vacation which covers this time or if, in the description of the Goods, the Seller has indicated that the shipping date will be longer.
The ordered Goods are delivered to the address specified in the order form.
The Buyer is informed about the order status via e-mail.
Receipt of Goods must be confirmed by a written receipt. At the moment of taking over the Goods, the ownership of the Goods and all risks associated with possession and use of the Goods, in particular the risk of loss, destruction or damage to the Goods, pass onto the Buyer.
Receiving the Goods the Buyer is obliged to check whether the shipment does not contain any damage caused during transport and whether it is consistent with the Order.

§ 6 Complaints

All Goods in the Store are new, unless the Seller has indicated otherwise
in the description of the Goods.
For physical or legal defects of goods, the Seller shall be liable to the Buyer who is a Consumer – on the terms specified in Article. 556 and subsequent Civil Code (warranty).
If the sold thing has a defect, the buyer can make a statement to reduce the price or withdraw from the contract, unless the seller immediately and without undue inconvenience to the buyer will replace the defective item to free from defects or remove the defect. This restriction shall not apply if the item has already been replaced or repaired by the seller or the seller has failed to satisfy the obligation to replace the item with a defect-free item or remove the defect. Buyer may not withdraw from the contract if the defect is insignificant.
If the buyer is a Consumer, may instead of the removal of defects proposed by the seller, require the replacement of the item to be free from defects or instead of replacing the item to require removal of defects, unless bringing the item to conformity with the contract in the manner selected by the buyer is impossible or would require excessive costs compared to the manner proposed by the seller. When assessing the excess of costs, the value of the item free from defects, the type and importance of the defect found, as well as the inconvenience to which the buyer would be exposed by another way of satisfaction shall be taken into account.
Claims of the Buyer who is a consumer to remove the defect or to replace the item sold to be free from defects shall expire after a year, counting from the date of finding the defect. Running of the limitation period can not, however, end before the expiry of two years, from the date of delivery of things to the Buyer.
A Buyer who is a Consumer and exercising warranty rights is obliged to deliver defective goods at the expense of the Seller to the address ul. Kleczkowska 49B/29, 50-227 Wrocław.

The returned Goods shall be accompanied by the Sales Document and the completed complaint form, which is available for download in the Contact section. The form shall specify the option the Client is interested in: repair of the Goods, replacement of the Goods, money refund or price reduction.
Complaints shall be processed within 14 days of receiving the notification.

§ 7 Withdrawal from the contract

Pursuant to Article 27 of the Act of 30.05.2014 on consumer rights (Journal of Laws 2020.287 i.e.), the Buyer who is a consumer, who has concluded a remote contract, may withdraw from it without giving any reason and without incurring costs (subject to paragraph 2), by submitting an appropriate statement to the Seller within 14 (fourteen) days from the date of delivery of the Goods to him. In order to meet this deadline it is sufficient to send the Goods and the declaration, together with the Sales Document before its expiry to the address: ul. Kleczkowska 49B/29, 50-227 Wrocław.
Cash on delivery shipments shall not be accepted.
A declaration of withdrawal from a contract may be made on a form that is available for download in the Complaints tab. The declaration of withdrawal can also be made in another form – in accordance with the provisions of the Act on Consumer Rights.
In the case of withdrawal from the contract, the contract is considered unconcluded and the Seller shall return to the Buyer, within 30 days of receipt of the declaration, at the latest, the payments made by him.
The Buyer shall be obliged to return the Goods to the Seller or transfer them to a person authorized by the Seller to collect immediately, but no later than 14 days from the date of withdrawal from the contract, unless the entrepreneur offered to collect the item himself. To meet the deadline it is enough to send back the item before its expiry. Buyer who is a consumer shall bear only direct costs of returning the item.
The Seller shall refund the payment using the same method of payment used by the Buyer, unless the Buyer being a Consumer has expressly agreed to a different method of return that does not involve any costs for him.
Returned Goods should be returned in an unchanged condition, bearing no traces of use beyond that necessary to determine its nature, characteristics and operation (try on).

§ 8 Personal Data Protection

The administrator of personal data is the Seller.
By placing an order at the Store, Buyer agrees to the processing of his personal data for the purpose of implementing the sales contract. Providing personal data by the Buyer, to the extent necessary for the implementation of the sales contract and its proper documentation is mandatory.
Detailed information on the processing of personal data and use of cookies is contained in the Privacy Policy located in the Store.

§ 9 Final provisions

Photos and descriptions used for presentation of Goods and the name, domain, logos and other intellectual property rights belong to the Seller, and the use of them may be only in the manner specified and in accordance with the Rules and Regulations or with the consent of the Seller.
In matters not covered by these Terms and Conditions generally applicable provisions of Polish law shall apply.
The Regulations do not exclude or limit any rights of the Buyer being a Consumer, which he is entitled to under mandatory provisions of the law. In case of conflict between the provisions of these Regulations and mandatory provisions of law, granting the rights of consumers, the provisions of these laws shall prevail.
Settlement of any disputes arising between the Seller and the Buyer, who is a consumer, shall be subject to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure. A consumer can also use the ODR platform, which is available at https://ec.europa.eu/consumers/odr. The platform serves to resolve disputes between consumers and entrepreneurs seeking out-of-court settlement of disputes concerning contractual obligations arising from the online sales contract or service contract.
The Regulations may be recorded, obtained and reproduced by printing them out or saving them on an appropriate data carrier.
The Regulations shall enter into force as of 01.09.2021.

§ 1 Przedmiot regulacji oraz zasady sprzedaży

  1. Niniejszy regulamin określa zasady korzystania ze Sklepu internetowego seelanii, działającego pod adresem https://seelanii-lingerie.com, składania zamówień Towarów dostępnych w tym sklepie, dostarczania zamówionych Towarów Kupującemu, uiszczania przez Kupującego ceny za nabywane Towary oraz uprawnienia Kupującego związanych z umową sprzedaży, w tym sprzedaży na odległość.
  2. Sklep internetowy https://seelanii-lingerie.com prowadzi sprzedaż za pośrednictwem sieci Internet (umowa zawierana na odległość).
  3. Do złożenia zamówienia niezbędne jest zapoznanie się przez Kupującego z niniejszym regulaminem i potwierdzenie tego faktu. Poprzez złożenie Zamówienia Kupujący potwierdza akceptację niniejszego Regulaminu.

§ 2 Definicje

Wszystkie terminy pisane dużą literą mają znaczenie nadane poniżej:

Dni robocze – dni tygodnia od poniedziałku do piątku, z wyłączeniem dni ustawowo wolnych od pracy

Dokument sprzedaży – dokument potwierdzający sprzedaż w formie faktury, wybrany przez Kupującego na etapie składania Zamówienia i dostarczany Kupującemu – w formie elektronicznej, na adres e-mail podany przez Kupującego

Forma dostawy – sposób dostarczenia zamówionego Towaru, wybrany przez Kupującego podczas składanego Zamówienia

Forma płatności – sposób uiszczenia ceny za zamówiony Towar, wybrany przez Kupującego podczas składania Zamówienia

Towar – rzeczy ruchome, prezentowane w Sklepie, mogące być przedmiotem umowy sprzedaży

Umowa sprzedaży – umowa sprzedaży Towaru, zawarta pomiędzy Sprzedawcą a Kupującym za pośrednictwem Sklepu a udokumentowana za pomocą Dokumentu Sprzedaży

Zamówienie – złożona przez Kupującego za pośrednictwem Sklepu oferta zawarcia umowy sprzedaży ze Sprzedawcą

§ 3. Składanie zamówień

  1. Do złożenia Zamówienia i zawarcia umowy, niezbędne jest posiadanie przez Kupującego skrzynki poczty elektronicznej (e-mail) oraz przeglądarki internetowej np. Chrome, Safari, Firefox itp.
  2. Zamówienie Towaru następuje poprzez wybór Towaru w Sklepie, podejmując kolejne czynności techniczne na postawie wyświetlanych komunikatów, w tym poprzez dodawanie Towarów do koszyka. Kupujący może w każdej chwili obejrzeć zawartość koszyka, dodać bądź usunąć Towary.
  3. W trakcie realizowania procesu składania zamówienia Kupujący zobowiązany jest do podania adresu wysyłki Towaru, numeru telefonu, adresu e-mail, wyboru sposobu płatności oraz może także zgłosić chęć otrzymania faktury VAT do paragonu.
  4. Kupujący może dokonać rejestracji w Sklepie. Rejestracja umożliwia zapamiętanie w bazie danych Sklepu danych osobowych Klienta oraz historii jego Zamówień, a także umożliwia dostęp do Zamówień.
  5. Podczas rejestracji Kupujący zobowiązany jest podać unikalne i znane tylko sobie hasło. Proces rejestracji oraz składania Zamówień jest szyfrowany odpowiednim protokołem.
  6. Kupujący jest odpowiedzialny za nieudostępnianie swojego hasła osobom trzecim oraz ponosi odpowiedzialność za jego udostępnienie.
  7. Po złożeniu zamówienia Sprzedawca przesyła, na podany przez Kupującego (w formularzu zamówienia) adres poczty elektronicznej, potwierdzenie przyjęcia zamówienia, obejmujące wszystkie istotne elementy zamówienia, takie jak numer zamówienia, łączna cena zamówienia (z wyszczególnieniem cen poszczególnych artykułów i ceny dostawy), czas realizacji zamówienia, forma i przybliżony termin dostawy.
  8. Do zawarcia przez strony umowy, dochodzi w chwili otrzymania przez Kupującego potwierdzenia przyjęcia zamówienia przez Sprzedawcę. Warunkiem przyjęcia i realizacji przez Sprzedawcę zamówienia, jest prawidłowe i kompletne (w niezbędnym zakresie) wypełnienie przez Kupującego formularza zamówienia.
  9. Zamówienie nie zostanie przez Sprzedawcę przyjęte, jeżeli w formularzu zamówienia Kupujący zamieści niekompletne dane, uniemożliwiające weryfikację Kupującego i należyte dostarczenie Towaru. W przypadku braku możliwości kontaktu z Kupującym z uwagi na podanie błędnego adresu lub numer telefonu, zamówienie będzie anulowane.

§4. Ceny i płatność

  1. Ceny wszystkich towarów prezentowanych w Sklepie są cenami brutto (uwzględniają podatek od towarów i usług VAT), wyrażonymi w złotych polskich (PLN). Wiążąca dla stron transakcji jest cena poszczególnego artykułu uwidoczniona na stronie internetowej Sprzedawcy
    w momencie składania zamówienia przez Kupującego. Cena towaru nie obejmuje kosztów jego dostawy, przy czym informacja o koszcie dostawy towaru podawana jest przy składaniu zamówienia.
  2. Koszt wysyłki Towaru pokrywa Kupujący.
  3. Kupującemu służy prawo wyboru sposobu dostawy i formy płatności. Wyboru formy płatności, Kupujący dokonuje w formularzu zamówienia.
  4.  Sprzedawca oferuje następujące formy płatności:
  1. płatność przez Internet w systemie PayU/PayPal/Blik w trakcie składania zamówienia, tj. podczas procesu zamawiania Towaru Kupujący dokonuje zapłaty za ten Towar,
    a zamówienie jest realizowane pod warunkiem uzyskania przez Sprzedawcę pozytywnej autoryzacji od operatora płatności elektronicznych oraz banku Kupującego;
  2. płatność przelewem na rachunek bankowy Sprzedawcy, przy czym zamówienie realizowane będzie po wpłynięciu środków na poniższy rachunek bankowy Sprzedawcy: Kristen Fernandes, ul. Kleczkowska 49B/29, 50-227 Wrocław, NIP:8992902944, numer konta: 24 1020 5226 0000 6302 0715 9942
    ,
  1. Koszt, termin oraz sposób dostawy Towaru wynikają z wybranej przez Kupującego w zamówieniu formy dostawy.

§ 5. Dostawa towaru

    1. Dostawy towarów zamawianych w Sklepie realizowane są na terytorium Rzeczypospolitej Polskiej.
    2. Sprzedawca w terminie 3 tygodni (liczonych wyłącznie w Dni robocze) od dnia uzyskania pozytywnej autoryzacji od operatora płatności elektronicznych oraz banku Kupującego, bądź od dnia wpłynięcia należności w pełnej wysokości na rachunek bankowy Sprzedawcy, wysyła na wskazany przez Kupującego adres zamówiony Towar wraz z Dokumentem Sprzedaży.
    3. Termin wysyłki Towaru może ulec wydłużeniu, jeżeli Sprzedawca ustalił urlop obejmujący ten czas lub jeżeli w opisie Towaru Sprzedawca zaznaczył, że termin wysyłki będzie dłuższy.
    4. Zamówione Towary są dostarczane na adres wskazany w formularzu zamówienia.
    5. O statusie zamówienia Kupujący informowany jest za pośrednictwem poczty elektronicznej.
    6. Odbiór Towaru musi być potwierdzony pisemnym pokwitowaniem. Z chwilą odbioru Towaru, na Kupującego przechodzi prawo własności Towaru i wszelkie ryzyka związane z posiadaniem i korzystaniem z Towaru, w szczególności ryzyko utraty, zniszczenia lub uszkodzenia Towaru.
    7. Odbierając towar Kupujący jest zobowiązany do sprawdzenia, czy przesyłka nie posiada uszkodzeń powstałych podczas transportu i czy jest zgodna z Zamówieniem.

§ 6. Reklamacje

  1. Wszystkie Towary znajdujące się w Sklepie są nowe, chyba że Sprzedawca zaznaczył inaczej
    w opisie Towaru.
  2. Za wady fizyczne lub prawne rzeczy, Sprzedawca ponosi odpowiedzialność wzglÄ™dem KupujÄ…cego bÄ™dÄ…cego Konsumentem – na zasadach okreÅ›lonych w art. 556 i nastÄ™pnych Kodeksu cywilnego (rÄ™kojmia).
  3. Jeżeli rzecz sprzedana ma wadę, kupujący może złożyć oświadczenie o obniżeniu ceny albo odstąpieniu od umowy, chyba że sprzedawca niezwłocznie i bez nadmiernych niedogodności dla kupującego wymieni rzecz wadliwą na wolną od wad albo wadę usunie. Ograniczenie to nie ma zastosowania, jeżeli rzecz była już wymieniona lub naprawiana przez sprzedawcę albo sprzedawca nie uczynił zadość obowiązkowi wymiany rzeczy na wolną od wad lub usunięcia wady. Kupujący nie może odstąpić od Umowy, jeżeli wada jest nieistotna.
  4. Jeżeli kupującym jest Konsument, może zamiast zaproponowanego przez sprzedawcę usunięcia wady żądać wymiany rzeczy na wolną od wad albo zamiast wymiany rzeczy żądać usunięcia wady, chyba że doprowadzenie rzeczy do zgodności z umową w sposób wybrany przez kupującego jest niemożliwe albo wymagałoby nadmiernych kosztów w porównaniu ze sposobem proponowanym przez sprzedawcę. Przy ocenie nadmierności kosztów uwzględnia się wartość rzeczy wolnej od wad, rodzaj i znaczenie stwierdzonej wady, a także bierze się pod uwagę niedogodności, na jakie narażałby kupującego inny sposób zaspokojenia.
  5. Roszczenie Kupującego będącego konsumentem o usunięcie wady lub wymianę rzeczy sprzedanej na wolną od wad przedawnia się z upływem roku, licząc od dnia stwierdzenia wady. Bieg terminu przedawnienia nie może zakończyć się jednak przed upływem dwóch lat, od dnia dostarczenia rzeczy Kupującemu.
  6. Kupujący będący Konsumentem, który wykonuje uprawnienia z tytułu rękojmi, jest obowiązany na koszt Sprzedawcy dostarczyć rzecz wadliwą na adres ul. Kleczkowska 49B/29, 50-227 Wrocław
  7. Do odsyłanego Towaru należy dołączyć Dokument Sprzedaży oraz uzupełniony formularz reklamacji, który jest dostępny do pobrania w zakładce Kontakt. W formularzu należy określić, którą opcją Klient jest zainteresowany: naprawa Towaru, wymiana Towaru, zwrot pieniędzy czy obniżenie ceny.
  8. Reklamacje będą rozpatrywane w ciągu 14 dni od otrzymania zgłoszenia.

§ 7. Odstąpienie od umowy

    1. Na podstawie art. 27 ustawy z dnia 30.05.2014 r. o prawach konsumenta (Dz.U. 2020.287 t.j.), Kupujący będący konsumentem, który zawarł umowę na odległość, może od niej odstąpić bez podania przyczyny i bez ponoszenia kosztów (z zastrzeżeniem ust. 2), składając Sprzedawcy stosowne oświadczenie w terminie 14 (czternastu) dni od dnia doręczenia mu Towaru. Do zachowania tego terminu wystarczy wysłanie Towaru i oświadczenia wraz z Dokumentem sprzedaży przed jego upływem na adres: Vivaldiego 20/16, 52-129 Wrocław.
    2. Przesyłki za pobraniem nie będą przyjmowane.
    3. Oświadczenie o odstąpieniu od umowy może zostać złożone na formularzu, który jest dostępny do pobrania w zakładce Reklamacje. Oświadczenie o odstąpieniu od umowy może być złożone również w innej formie – stosownie do przepisów ustawy o prawach konsumenta.
    4. W razie odstąpienia od umowy, umowa jest uważana za niezawartą a Sprzedawca zwróci Kupującemu, najpóźniej w terminie 30 dni od dnia otrzymania oświadczenia, dokonane przez niego płatności.
    5. Kupujący ma obowiązek zwrócić Towar Sprzedawcy lub przekazać ją osobie upoważnionej przez Sprzedawcę do odbioru niezwłocznie, jednak nie później niż 14 dni od dnia, w którym odstąpił od umowy, chyba że przedsiębiorca zaproponował, że sam odbierze rzecz. Do zachowania terminu wystarczy odesłanie rzeczy przed jego upływem. Kupujący będący konsumentem ponosi tylko bezpośrednie koszty zwrotu rzeczy.
    6. Sprzedawca dokonuje zwrotu płatności przy użyciu takiego samego sposobu zapłaty, jakiego użył Kupujący, chyba że Kupujący będący Konsumentem wyraźnie zgodził się na inny sposób zwrotu, który nie wiąże się dla niego z żadnymi kosztami.
    7. Zwracany Towar powinien zostać odesłany w stanie niezmienionym, nie noszącym śladów korzystania w zakresie wykraczającym poza sposób konieczny do stwierdzenia jego charakteru, cech i funkcjonowania (przymierzenia).

§ 8. Ochrona danych osobowych

  1. Administratorem danych osobowych jest Sprzedawca.
  2. Składając zamówienie w Sklepie, Kupujący wyraża zgodę na przetwarzanie swoich danych osobowych dla celów realizacji umowy sprzedaży. Podanie przez Kupującego danych osobowych, w zakresie niezbędnym do wykonania umowy sprzedaży i właściwego jej udokumentowania jest obowiązkowe.
  3. Szczegółowe informacje dotyczące przetwarzanie danych osobowych oraz wykorzystywania plików cookies zawiera Polityka Prywatności zamieszczona w Sklepie.

§ 9. Postanowienia końcowe

    1. Zdjęcia i opisy użyte do prezentacji Towarów oraz nazwa, domena internetowa, logotypy i inne prawa własności intelektualnej należą do Sprzedawcy, a korzystanie z nich może następować wyłącznie w sposób określony i zgodny z Regulaminem bądź za zgodą Sprzedawcy.
    2. W sprawach nieuregulowanych niniejszym Regulaminem majÄ… zastosowanie powszechnie obowiÄ…zujÄ…ce przepisy prawa polskiego.
    3. Regulamin nie wyłącza oraz nie ogranicza żadnych uprawnień Kupującego będącego Konsumentem, które przysługują mu na mocy bezwzględnie obowiązujących przepisów prawa. W przypadku sprzeczności pomiędzy postanowieniami Regulaminu, a bezwzględnie obowiązującymi przepisami prawa, przyznającymi konsumentom uprawnienia, pierwszeństwo mają te przepisy.
    4. Rozstrzygnięcie ewentualnych sporów powstałych między Sprzedawcą a Kupującym, który jest konsumentem, zostaje poddane sądom właściwym zgodnie z postanowieniami właściwych przepisów Kodeksu postępowania cywilnego. Konsument może również skorzystać z platformy ODR, która dostępna jest pod adresem  https://ec.europa.eu/consumers/odr. Platforma służy rozstrzyganiu sporów pomiędzy konsumentami i przedsiębiorcami dążącymi do pozasądowego rozstrzygnięcia sporu dotyczącego zobowiązań umownych wynikających z internetowej umowy sprzedaży lub umowy o świadczenie usług.
    5. Regulamin może zostać utrwalony, pozyskany i odtworzony poprzez jego wydrukowanie lub zapisanie go na odpowiednim nośniku danych.
    6. Regulamin wchodzi w życie z dniem 01.09.2021 r.
